“Gender Equality: The Constitution & The Laws”

Though inequalities are a fact of life, constitutional law cannot pander to existentialist realities. It hitches itself to ideals and to the felt necessities of the times. Article 8 of the Federal Constitution commands legal and formal equality. Unfortunately, gender bias cannot be exterminated by recourse to the law alone. Social and functional equality i.e. equality in outcomes is hindered by traditions as old as the times. To combat these, the battle has to be waged on many fronts. We all have a role to play.
